Money I gave away

Hello again,

I'm going to file BK in mid June. At the end of December I gave $6500 to my fiance for safe keeping. I had no idea the BK was in my future at that time and I knew NOTHING about it. I just knew that I was going to loose my house to foreclosure and didn't want my lenders to know I had any money.

He bought me a computer with $1500 of that money so now he still has $5000. It seems like if I want him to keep the money then I'll have to wait until next January to file. I want to get it over with asap. So I'm going to get the money back from him and use it on a new car.

I gave him the money in cash and he put it in his account. Should he give it back to me in cash or can he just give me a check for it?

I'm worried about explaining this all to the trustee. I was trying to hide the money from my lender... I don't know why, I was just freaking out!

How should I get it back without it looking funky?

If 6500 comes from VISA/MC, wait 6 months to file. If 6500 from personal bank account, close that account, and have bank statements show trustee no funds existed avalaible before file.

I pulled the money out on 12/29/08 and closed the account. Opened a new account with a different bank. Are you suggesting that he could keep the money? Wouldn't the trustee want to know where the money went? Will they even look back that far?

Won't the trustee ask me if I have given away any money in the last year? I don't want to lie.....

How many months of bank statements do they want to see?

I guess if the trustee asked I could say that I just spent the cash over the last 6 months.... It was only $5000 but I would rather use that money for our future wedding than use it on a car. I don't know. Any other suggestions. I just don't want to get in any trouble with the trustee.

Closed account, 3 months is OK, I think. Hopefully, trustee won't ask.
