    Filing chptr 7 in GA...my story

    I have had my consultation with an attorney and I qualify to file Chp 7, an under median. I am filing alone, not my husband. I have 3 CC, a line of credit at my bank, and a loan with a small finance company. Pretty cut and dried I think. Going to reaffirm the car and our HELOC, they are in both of our names. The house mortgage is in my husbands name only. I am now scared to death of the "TRUSTEE". I have not paid anything yet but I am going to in the next week or so. I have all of my papers together and think I am ready. What can a trustee find out about you? And how difficult can they make this for me.

    I suppose everyone is a bit afraid of the Trustee, after all he's there to find money if possible for the creditors. He can greatly affect your life. Not sure of the amounts involved but if its pretty clear cut and your under median income with less than 100k debt to be discharged then it probably will not be to hard. About 5 minutes or less in a 341 meeting 30-45 days after filing with discharge approximately 60 days later. If your debt is more than 100k then yes there will be some more scrutiny and the UST becomes involved but even then if its pretty clear cut you should have no trouble.

    You'll feel better once you've filed and get passed the 341
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      Yes my total debt is under $100,000. Only about $35000. I have a small finance company near my work that I have been continuing to pay and I also have a CC in my name but my sister pays the bill because she bought something for my nephew on it. I am thinking I need to tell her to stop paying on that, right? And as far as the finance company, I will either reaffirm them or put them in the BK and pay them anyway. I think that finance companies like that are more likely than a bank to loan you money after something like this and I can use it to at least add some positive to my credit history.

        Why are you worried about the Trustee? Your case seems like it will go smoothly.

          Well I really wasn't concerned about the Trustee, wasn't truly sure what their purpose was, until I started reading about it on this forum. Some stories are awful. I think my case will be pretty simple but I am nervous. Because some times things look different on paper than they are in real life, if that makes sense. I am a nail technician and back in July my credit score was 720. Last time I got notification about it it was 388. We were approved to refiance our mortgage and do an addition to our house. I mean things can change on a dime. BUT God is good. I am not losing my home or my car. If losing my credit rating is the worst thing that happens to me then oh well.
