    what does this mean????

    As I mentioned on another thread-- the UST was at our meeting yesterday requested doecumentation--

    I logged on to Pacer and this is there...

    Full docket text:
    Meeting of Creditors Held and Concluded on 3/11/2009.         Took 115 days after 341 - But Finally DISCHARGED 3/25/09

          that is what I thought.. but because we are being audited---now will I here from the UST about the extra documentation and all that???? Does that get posted to pacer infor about the US TRUSTEE??? Or could I be so hopefull that they already came to a decision???

            The trustee's report of no distribution came from the panel trustee (Ch. 7 Trustee). The U.S. Trustee has authority over the panel trustee, and the presence of a UST attorney at your 341 is not a good sign. Occasionally, the UST attorneys will appear to ask a few questions and they'll never be heard from again, but this seems to be rare. Even though the panel trustee has filed their report of no distribution, you are NOT in the clear!

            The UST does not ask for additional documentation for grins - something in your petition has caught their eye and they may disagree with your means test. Is your income above median? Are you discharging a lot of unsecured debt? Regardless of what triggered the request, you need to be on your toes right now and get absolutely every item the UST has asked for directly into their hands.

            Was your 341 meeting concluded or did you receive a continuance?

            Not trying to worry you, but you need to know that everything is not o.k. and that you are not in the 60 day club until the UST decides you're in the 60 day club. Sorry!

              that is what I figured and we are getting the documentation together now...
              Our 341 was concluded... What would that be-- shouldn't it have been held over due to additional information requested???

                No, the case moves along the way it would normally with the UST's involvement in the background. If your 341 hearing is concluded, you'll know within 10 days of that date what the UST's intentions are. They have 10 days to file a statement of presumed abuse. Keep an eye on PACER.

                If that happens, don't panic - it is just a statement the UST is required to file if they disagree with your means test.
