    Judgment Ahead?

    Hi All!
    I'm a new member but not so new to this BK stuff. I went through a Chapter 7Bankruptcy and received my discharge December 2008. I got married in October, and we planned to pay my husbands debts off as they were significantly less than mine were.

    We're high school sweethearts and have been together for 6 years, married for less than 6 months. He's been off work two years due to a disability, and I've only been able to pay his secured debt - payment on our vehicle and our wedding rings / my engagement ring. But let me get to the point.

    I was programming numbers into his phone so that the leaches wouldn't wake us up early (I work 2nd shift for the great premium pay), and I was running the numbers in google to save them under the Collection Agency. I found one that went to a Law Office that represents creditors, and now I'm VERY worried.

    It's a firm called Shermeta, Adams & Von Allmen. They've only called once, and it was last Saturday and my husband missed the call so he didn't speak with them. None of his accounts are with original creditors, they all went to Collection Agencies A LONG time ago. It has been around 1 1/2 to 2 years since payments were made on some of these accounts. We've been working to settle debts and settled two of his last year before the wedding, but there just hasn't been money to settle more. We've been following Dave Ramsey and wanted to follow his plan, (which we paid $3000 off in three months, so it works, just not fast enough in our situation I guess), and I'm pretty sure that just threw a wrench in our plans.

    I was under the impression that he was judgment proof, but I'm VERY scared. We don't own anything outright, I'm the only one with income right now. I'm scared they'll come after the ONE bank account in our names.

    Am I right in thinking a judgment may be in our future and we should file for him when our tax return comes in? Or am I jumping to conclusions?

    I also wanted to add that he kept up his payments until around October 2007, that's when he lost his job / long term disability insurance. So it'd be two years this October that he'd have stopped making payments.

      Do you live in a communtity property state?

      IF not, can you open up an account in your name only and use that until things settle down?

        Can you get a bank account in your name only?... Not sure that would even help but just an idea. Also have you got anything in the mail from them?

          It was originally my account, I could take him off and it wouldn't hurt anything, right?

          I live in Michigan, as far as I know we're not community property. Currently, we haven't received anything in the mail; just that call and it spooked me good. I'm having my husband call the County Clerk tomorrow to make sure there's no judgments out there floating around. We haven't been served or anything of that nature.

            You might be able to look online to see if there is a court date or judgement.

            See if your court has online acesss to the civil index. It is usually pretty easy to search and most courts allow online access now.
