341 meeting tomorrow..

We have our 341 meeting tomorrow morning. Right now we are kinda stressed out hoping it goes as smooth as most peoples 341 have gone in the last month.

My lawyer hasn't been a help at all. Whenever I call or email him he keeps telling me all the answers are in the document he sent me. He says all my assets and Child tax credits are protected but I really don't trust him. I guess we will find out tomorrow. This site has helped me more than my lawyer. lol..

No he's not attending the 341 meeting due to weather. We received a lot of snow yesterday and he's not going to risk driving 45 miles. Which I am ok with.

Tell him you want 300.00 per hour back of your fee. Sorry , I am being pissy, but isn't that what you pay a lawyer for? If you came to him with extra work he would most likely charge you.

You have to show up, he should to or at least reimburse you for the time he isn't spending on your case.

Back from 341 Meeting.

Well I survived the 341 meeting.

The trustee asked all the normal questions and then asked if we had a copy of our February bank statement which I gave to my attorney.

The Trustee also asked how much my tax return was but she didn't ask for it. Does that mean I can spend it? Or should I just wait until the discharge?

Hi TJR70: Apparently the 341 went well, CONGRATULATIONS and welcome to the 60 Day Club.

On the tax return, I think I would hang onto it for a while, or if you do spend it, spend on things like food, staples for the household like soap, shampoo, paper towels--stuff like that. Or needed repairs to household items or to the car.

I am so jealous of all of you that get these great tax refunds. After paying the tax man, we usually either break even or have to pay a little.

Maybe I need a few more dependants ------NOTTTTTTTTTTTTT.

Congratulations on making it through. I would be a little irritated at the lawyer for not showing up. If it is in your contract that he shows up....he needs to do something for you. 341's are scary and it helps to know that your lawyer is there right beside you so you don't screw up.

I would wait to spend that refund until you get the green light from the trustee and your attorney. Or wait for the discharge and be free and clear. Put it in your savings account (if you have one) and you won't be tempted to spend it.

knguye11 depends, if you are preparing to file then yes. If you've already filed I'd wait til the trustee indicated he wasn't seeking it.

Thanks all. It feels like a thousand pounds are lifted from my shoulders. I also got the $375.00 dollars from my attorney for not showing up and not sending in my bank statements when he filed my BK. Well he said the check is in the mail.

Believe it when you see it and if he actually does it...He was a decent lawyer. Owned up to the screw up and for not showing to your 341. You are much better than I would be about representation at the 341.
