I don't think I understand about letting 3 months pass. I'm not thinking of filing until Oct. or Nov. so what 3 months are we talking about?

I hate, though, when it happens to nice people... like the Cats. The whole thing makes sense to me, but at the same time, it doesn't make any sense.

Just as you, I'd rather educate people on being honest, and just letting "time" correct the honest oversights. I wish there were more things I knew about "timing" things... but we all learn.

Thanks Hub. I needed to hear that too. I've been doing the red wine all night, and the bathtub is filling up. You sound like a good person.

Yup. But because I am single, no dependents, car paid for, and I rent, I just don't have the same obligations that a lot of other people have.

                    Uneasy,
State exemptions apply to you regarless of you being single with no dependents.

I looked at my state's exemptions and allowable expenses and I am probably confusing the two. I took the means test a couple of times playing out a couple of different scenarios, and, because my income is just so unpredictable, don't know if I would pass it.

Exemptions are property and assests (like furniture, car, ira, etc). Allowable expenses are your bills ( utilities, rent, food, clothes, health related expenses) which is the standards for the means tests.

Thanks for clarifying that. I don't own much property--some old furniture and a 2001 (paid for) car--and my expenses are just those of an ordinary single person who rents, so that's why I'm concerned.

Another question. I know I'm not supposed to pay back money borrowed from family if I'm not paying other creditors. I haven't made any cc payments in months, but I haven't filed yet, and am wondering this--

If, before I file, I take cash out of the bank and pay people back in small(ish) increments, how could the trustee know?? I know there are all of those things about having to swear under oath that you didn't do this, but, hypothetically, let's just say I did. And IF I did, who would know? How COULD they know? If I take $500 out of the bank every now and then months BEFORE I file, would anyone ask what I spent that on?? Would anyone even know or ask what I was doing with my money 5, or 6 or 7 months before filing?

                              Thanks again.

                              I am Uneasy. . .
OMG - you don't know about the Trustee's crystal ball? (just joking....)

Put it this way, if you are thinking about what you are doing prior to filing BK and figuring out how to hide it, your attorney, trustee and their staff have long ago through of it also and are well aware of tactics taken that they can check out if they wish. Always be open, honest and forthright in dealings with your legal counsel and trustee and you will never run into any problems to get through your Bk filing. Best of luck to you.

OP - Just wait, don't pay them till after your case is discharged. Why mess up your one chance to file? if you are dismissed, just think about how much worse off you will be!

If you are not honest now, you will regret this for a long, long time. The trustee's are very, very savy and they are to make sure things are honestly played out.
