    Can I use my checking now?

    Just wondering if it is safe to direct deposit hubbys checks now that our 341 is over. We were only putting a little money in and saving some. I just don't trust anybody.

    I changed my bank account to a bank that I didn't owe money to, just in case. Now we deposit our checks like we used to. Haven't had any problems.

      Is this the same checking acct you were using before you filed? When my case was filed, my attorney advised me to get a different acct at a different bank, and that's exactly what I did. I have my payroll checks directed deposited into my new acct, and so far, I haven't had any problems.

        I had a Credit Union I owed credit line. So I opened new account too. The CU had assured me they would not be able to touch my checking after the bkrptcy filing. But I too, did not trust them. I opened a new account online with Suntrust in my area. Mainly they just check a Telecheck system( which keeps track of bad ck writer). I had a judgement and it approved me no problem.
        My attorney told me the file date is the important date.

          This is a new account. I just wasnt sure if they check your accounts or not.

            If it's a new acct with a bank or CU you don't owe money to, then I would think you should be ok.

              We are getting ready to file and currently have our checking account at a bank where we do not owe any money. Also, we had opened this checking account after we had stopped paying our credit cards, so they don't know the information, though it will be on the BK petition. I don't think we would have a problem. Anyone know of a reason we would have a problem with this?

                It never even occurred to me to be worried about my checking account. I didn't owe my bank any money though. But I still have the same account, have my paycheck direct deposited, and use it as normal (including debit card use) with no issues.

                  Is this the same account that you had when you filed? I am just wondering why you weren't depositing the checks in there to begin with? If it is a different checking account, which by the way i would sugest anyone to close the account out and reopen another one not tied to any cc's.


                  Before we filed i immed. close out my old account and reopend another one, naturally not tied to any cc's.

                    We opened this account before we filed per our attorney. We have no cc or loans with them. But we were just nervous about depositing all of our money in there. I guess we have to pay bills and can't really save any.

                      Its fine to deposit money in there. I did and never had a problem. As long as no cc's are tied to that account and that you have not given permission to any creditors to deduct money from that account, you should be just fine.
