    stolen 4 wheeler

    Going to file tomorrow for Chapter 7. I am very concerned because we brought 2 four wheelers 3 years ago. We still owe 3500 on them. One of them got stolen 1 year ago. But we didnt file a police report. I dont want the other 4 wheeler, even told my lawyer. What will happen as far as the one that got stolen goes? Will they sue me? I dont want them to think i am hiding it. Should i just reaffirm and pay for it anyway, although i cant afford it? Sorry for stupid questions,

    If it's a secured loan you will have to pay for it.

        Probably stolen by a relative or friend!

          No it wasnt. sorry But I am honest person, and YOU dont seem to think so, even though you dont know me! My son, he is 20,yrs old, left it on back of his truck at a lcoal race track and someone stole it off back of his truck. My husband and him did not file a police report because they thought it would do no good. They said whoever stole it probably painted over serial numbers and everything, Geez, do you not believe that some people in this world are good, honest folks???

            yes I did tell my lawyer. He asked me if I planned on keeping 4 wheeler,, I said no. But I, BEING VERY HONEST PERSON THAT I AM would rather pay for it,, even if i dont have the other one still. I mean, its my son's fault that it got stolen, so I do agree I should have to pay.

                It's a shame you didn't check your house insurance policy at that time to see if the theft could have been covered. However, they would have required a police report. Was the area where your son's truck parked under video surveillance? The police could have checked all that out and the information helpful to police in the event there may have been a rash of burglaries/thefts going on at that time in your area. It is always best to call the police if there is a theft over a certain amount and report it (i.e., say over about $500), especially if there may be insurance coverage involved.

                I understand how quickly things can disappear and all one has to do is turn their back for a split second and it is gone. If someone wants something, they will find a way to get it.

                  I don't really know or care whether you are hiding it. I simply put myself in the shoes of a trustee and wondered out loud. Your reason for not filing a police report is tough to swallow.

                  I assume you have homeowner's insurance. If you had filed a report you may have been able to collect on it. Did you at least deduct the loss on your taxes?

                  Making a police report is a good idea whether yo intend to collect the lost property or not. Alerting the police to criminal activity leads them to keep an eye out for the stolen property, patrol the area more and allow others to know what is happening.

                    Well, what's done is done. I'd list it on the creditor matrix and see what happens. Given the value, they just may abandon the property.

                      i did call my homeowners insurance when it got stolen, but they wouldnt cover it. Anyways, it was a mistake not to file a police report, more my husbands and son's dumb mistake. Total price for both was $6,400. i owe $3,500. The other one is not even running, i just want to do everything right so i wont have any trouble getting my discharge... even if i have to pay it back,, i will. Just wondering if i can reaffirm this?? going to lawyer in 2 hours, so i will ask him. Sorry for the long post, but thanks for answering.
