    What to do if surrending vehicle

    Once we file we will be about 3 months late on vehicle payment. We owe alot more than it is worth. We are giving it up. They call 5 times a an hour every other hour.

    After we file, do I call and tell them we filed so they will quit calling? I was under the impression that even when we file, the lawyer has to put an intent, and if it is intent to surrender they can come repo it.

    I want to turn it in but dont want to get a repo on report, just a iib. what do I need to do after we file?

    The creditor will make a motion for relief of stay so they can repo the car. after they get the relief you can all them and tell them to come get it.

      So do I need to tell them when I file and what happens if they do come get it after I tell them I file? I am just trying to figure out how much time I have to drive it still

        if it makes you feel any better we filed in Oct 08 and are surrendering our car, and they have yet to come get it.

          I waited until I had the BK filed and I told them to call my lawyer and thats it.
          In three words I can sum up everything I've learned about life: "It goes on".

            It depends on what the value of the vehicle is. If it is worthless they won't come and repo it even if you are surrendering. If your car has value, at any time if you haven't filed yet they can come and repo the car without you giving it up voluntarily. But if you are filing soon, you can most likely drive it until they have filed a motion and it is granted by the court.

              Last time I talked to them they told me I owed 30k on it(more than I even financed?) and it is only worth 11k. One of the reasons we are giving it up.
              They call me 5 times an hour every other hour so it is getting old fast
