    Question on renting after filing, Help!

    My husband and I filed Chap 7 on Feb 19th. Our house is in foreclosure and due to be sold on June 2nd. Waiting for our notice for our 341 meeting. When I was signing papers with lawyer I asked about finding a rental since we won't have a home after June. He said we should try and be out by May. We finally found someone to rent to us and we have to pay the normal fees to get in, should this be problem? We already filed but haven't had the 341. If we take this rental, fearing we won't find another will this be an issue? Our lawyer didn't tell us to wait, just said we should try and be out at least a month before our house goes to auction. Any advice??

    I notified my mortgage company of my intent to return the house to them last August and then left the house, moved to another city, and rented a house in October. I don't even think that my house is technically in foreclosure yet. The last time I contacted the mortgage company they said they were behind on foreclosures and that I had done all that I needed to do and to just sit tight. My lawyer knows all of this and was fine with it. What is your specific concern?

      My concern was the money we had to pay for 1st, last and deposit. We did it after we filed but before 341 and family helped us with it. I heard they ask if we have given anyone more than $600 in a certain time frame and we didn't before we filed so we should be ok, right?

        I'll let someone with more experience give you a more definitive answer, but I have a hard time imagining a more legitimate expense than putting a roof over your head when you are about to lose your home. It sure seems to me that you are doing the prudent thing.

            Thank you for your help. I am just a worry wart. I asked my lawyer when we filed and he said to get a place by May so I should quit worrying. He warned us it would be hard to find a place so start looking. I just want this whole process done with.

              Sweetie, (excuse the expression, it is of reverence) we have all been there. We all know what you are going through. Trust what I say as I am not the first to say it here. It WILL get better. Train yourself NOW for a lesser lifestyle, as you know, you have lived beyond your capabilities, as we all have. Also know you are among friends, who have hurt as you are now. Some are still in the “process”, some are beyond and have learned. ‘Hub
