    paying the trustee

    If I owe the trustee money from my tax return, do I have to take that money to my 341 meeting, or can I send it in to them/

    No, you don't take money to your 341.

    The Trustee will ask you if everything is true in your petition, did you sign the documents, do you have any assets you didn't list, blah blah.

    He will most likely make a determination at the 341 whether you are a no asset or asset case.

    If things look a little fishy or if creditors show up and say you have assets you are hiding ( which is usually very unlikely) then he may contunue the 341 or ask for more documentation.

    Do you have a lot of assets? Own a home with a lot of equity?

    What is your BK like?

      I have a home...paid 135000 for it, still owe 133000. So i dont thinki have much equity. I also have a car.

                Molly - you will probably know before your 341 if the trustee is going to have a problem with anything. Believe me the 341's are usually a breeze. Mine was a matter of 3 minutes maybe.. Although, I did have the UST step in 2 weeks after we filed, because we are over the median and I have about 190K in debt.

                Don't stress over the money with Walmart, again, if your attorney tells you not to worry about it, then he knows what the trustees are like in your district. Some trustees are sticklers are some are laidback. Maybe you have the laidback type. You will be fine. I was stressing over a wedding gift that I gave to someone about 2 1/2 months before filing. My attorney said not o worry, but I did and you know the trustee never asked about it. It was alot of money but i was a family member and 3 of us were in the wedding party.
                Don't sweat it, things will be fine.. DO you have alot of debt to discharge? are you under or over the median? If you are not over the median, chances are you will skate right thru with not problems.

                  I only have about $30,000 in debt to discharge, and I was under the median. I am hoping I will be okay...it just makes me nervous not knowing what kind of Trustee I will be getting that daY!!!
