    Heard from BofA yesterday, filed/341 already

    Got a call from a guy yesterday saying he could help us work things out with them. We filed 1/15, had the 341 2/24. During the auto stay they aren't supposed to call!?

    Does his calling mean that there is possibly an account that was overlooked in the petition? I looked it over and they are all there. Oddly though, when we log into B of A, most accounts have been removed except for one. But it IS listed on the petition. I tried calling back but they were closed. I emailed my atty's office, see what they say tomorrow.

    That is a direct violation of the stay, inform your attorney, you might be able to sue them for it.

      Husband reminded me of something though. Could be this. We have a checking account with them we emptied due to several accts with them being in the BK, but we never closed it. That acct has since become overdrawn due to monthly fees. We need to bring it current (like $45) and just close it. It could be that!?

        I had a lot of problems with BoA after filing. They called no less than 3 times (after they were informed of the BK) before they got it through their fat heads that I had filed. Each time they called, I would tell them that I filed, on what day, and my attorney's info. One guy and one woman actually argued with me when I told them they were violating the automatic stay.

        All the while I was still getting bills from them. Despite the fact that were discharged in Nov., I also got a Nov., Dec., and Jan. bill from them. After getting each bill, I would call them and tell them that 1) I filed for BK and 2) have since been discharged. I guess I finally got through to them because I didn't receive a bill for Feb.

        It could be, like in my case, that they know but just don't care.

          My atty's office said B of A is THE worst for this. I called them back and gave them the case #. It sucks that they are able to pick and choose which laws to abide by, but we could never get away with that as a consumer.

            Tromploi you have to watch B of A like a hawk when you cancel your accounts. Worse than Lazarus they keep coming back from the dead and you can guess with extra "overdraft" fees and negative balances too. We closed our personal and business accounts with B of A in mid-November. Took two separate trips down to the bank lobby to get it done. One trip withdrawing all funds out the personal checking and savings and closing it. The business account was the second visit and even required the business loan officer to process the closure. I have statements showing all accounts closed and zero balance.

            December comes and we received a statement with a negative balance on both the personal and business accounts plus a service fee charge of $15 for each account. Since B of A never charged us a monthly fee on either account it was interesting to receive the statements. Two telephone calls later accounts are corrected, fees reversed, apology given by B of A rep etc. January same thing happens. Statements with negative balances arrive with new administrative fees and a repeat of the same phone calls to the B of A reps. February statements were finally accurate and showed zero balances on everything. Stay on top of it until you get that final zero statement.
