    Foreclosure after discharge

    My chapter 7 has been discharged and I am awaiting closing. I am surrending property in the BK. Now that I am discharged, I am getting foreclosure "notice of defaults" letters from the lenders attorney.

    I just want to make sure my thoughts are correct. Here goes.... The lender has to wait until I am discharged to take back the property (or get a relief of stay). After discharge, do they have to do a standard foreclosure or can they just take it back? Are the foreclosure notices anything to worry about even though the properties were included in my BK?

    Those foreclosure notices are nothing to worry about. Even after you are discharged and your case closed, the lender still has to abide by your state foreclosure laws and time line.

      You don't need to worry about anything. you can not just turn it over to them. they have to go through the foreclosure. enjoy living rent free as long as you can.

        I lived "Rent Free" for almost a year!
