question about medical expenses pre- and post-filing

I've sort of asked this question in another thread, but want to be very specific about it here. I have a medical condition that results in chronic, disabling pain. A year ago I sought expensive treatment from a specialist (all out of pocket) and started feeling better for the first time in years. Then, last summer, when my business and finances crashed, I could no longer continue with treatment or medication. Now I'm right back where I started. Some days I can't even get out of bed. Lots of sleepless nights--really messing with my ability to work.

Now, right when I'm about ready to file, my business started picking up and I earned about $22,000 in Jan and Feb (that's gross-that figure includes expenses and I still have to pay taxes on it). I have no idea what the rest of the year will be like, but right now, I have a lot of money sitting in my bank account. I'll pay my 09 first quarter estimated tax payment, but then I'll still have a serious chunk of money for the trustee to seize. ( I WAS going to file next week.)

Here's my question: if I were to go back to another specialist (moved-can't go back to the old one) and ask to pre-pay on my treatment so that I can get regular medical help again, would that be ok? That will likely be a check to the doctor of several thousand dollars (probably $2,000-$4,000 + prescriptions).

What do you think? Am I allowed to try to get my health back with the money that just came in? BTW, I am a sole proprietor.

    Thanks!

Generally paying ahead is not allowed.

Health insurance though probably would be high but it would be acceptable but for a preexisting condition would take months to kick in.

Based on lots of good advice I've gotten on this forum, I'm thinking I'll wait to file. That way I can spend the money that just came in on some really necessary things, like medical expenses. There really is no urgency to file, but there is considerable urgency to get some pain relief and get my health back. I am uninsured right now, but can't wait to see a dr. until a new policy would kick in.

      Thanks for the input.
