    Tax refunds

    Hello everyone! I am new on here, but have been reading a lot. This is the best website I have found! Anyway, I got a 2 quick questions. Husband and I are going to file chapter 7 next week. We already met with our lawyer on Feb. 6. We got our tax refund and spent it on catching up two house payments,and the rest we saved for lawyers fees. is that going to be ok? Question 2: My mom is 68, a widow, and she deposits money in our checking account so I can pay her bills. Also, if i go to the store for her, i pay and she pays me back. Is that going to be a problem? please answer someone,, scared,, and worried!

    You will have to list the account when you file because your money is also in there.

    How much money is your mom putting in the account? Can you adjust the bill-paying so the amount in this account on filing day is below what your exemptions can protect on filing day? What does your lawyer say about this?

      She normally puts in $1000 a month. i did tell my lawyer, and he wrote it down. On the day I file, I will only have 20 dollars in the bank. I am just scared the trustee wont believe me because I have no proof this is not my money.

        You do have proof. By what method does the $1,000 come into your acount each month? Personal check? By what method do you account for the purchases you make on her behalf?

          She is on Social Security so she deposits most, BUT NOT ALL, of her check. i pay her bills online, so I can prove that with bank statements. I am very very honest.
