    chapter 7 and homeowners

    My husband wants to files chapter 7 bankruptcy and our mortgage loan is in both of our names. After looking at the Virginia State Exemptions I do not see an exemption that covers a home worth $300,000 with $130,000 in equity. I know I can file a homestead but I thought that only gives me $5,000 in exemptions. Is there a way to avoid the bankruptcy court from selling my home?

    Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

      I would check the value to be sure you actually have that much equity since the home values have dropped so much. Also, if giving up the house is not an option you could look into a Chapter 13 instead. I would find an attorney and get a free consultation.
