    Creditor still taking money out of my bank account.

    HFC took $161.34 out of my account in January and I called them and they said the automatic payment option I was using wasn't canceled. I figured that they would be notified of my Chapter 7 bankruptcy and they wouldn't be billing me anymore. Well, they said they discontinued my auto payments when I talked to them but then they also took another $161.34 out of my account in February. Crap!

    That put me in a bind. I recently had work done on my car and had only 60 cents in my bank account when they did that. I ended up being overdrawn on 4 transactions and now owe $140 in overdraft fees.

    I wrote for a second time and asked them to refund my money plus the overdraft fees. Do you think they will do that?

    What else should I do? I told them I have rent due on the 1st of March and need that money to pay my landlord. I've never really thought too highly of HFC and bet they'll either take a long time to reply or will ignore me altogether.

    Geez, I wish all this crap with money would just stop. What a pain.

    Anyway, thanks for letting me rant.

    Interesting, I had the exact same situation with BofA. Of course I havent had any experience with HFC but BofA definitely didnt refund any of my money. $253 hold on my account on 2/09/09. 6 pending transactions which all added to less than $60. 6 overdraft fees @ $35 each= $210. In one day BofA took $460 of my money!!!!! Im currently $-132 on my account. It will stay like that forever, I promise!

      You may want to put a stop payment on all withdrawals from that company. Also, try contacting the bank to let them know that you had already revoked authorization for HFC to automatically debit your account when the money was taken out. They may at the very least give you a break on some of the NSF fees or at the most refund it all and go after HFC for the money back.

      It's a bummer that you two had to deal with this situation!

        Did you file with a lawyer?

        If so you need to let him know.

        If not, do you get a paper check when you are paid. If so go and try to open a new checking account at another local bank. It might be harder since you are already in bankruptcy but hopefully someone will work with you.

        I'd also go the bank office and talk to someone. Dispute the withdrawal stating that authorization was revoked and demand your money bank in there and the bank to remove the over the limit fees. Make sure they are aware you do not authorize this company to electronically debit your account. (You might have to ask to speak to the bank manager, you might take your notice of the bankruptcy you received so you can show it if necessary).
