    Selling personal property before filing

    I lost my job in November of last year. Because of this my, wife in I will be filing ch 7 probably in March or April once our 6 month income is low enough to qualify under the means test.

    Because we don't have enough cash coming in for day to day living expenses (with just my wifes income), we recently sold our jacuzzi for $500 which was a fraction of what we bought it for. Will this be an issue? We met with a BK attorney at the beginning of the month and paid him a retainer. He asked me at that time what sort of personal property such as furniture, tv's, etc, but he never asked me about the jacuzzi and I never even thought about it at the time.

    yeah well list ALL property. Remember it's not your lawyer in the hot seat it's you.

      I would not worry about it. 500. might be a fraction of original cost but probably was market value for sale and moving of it.

      You can sell anything you want to for market value before you file.

        Any job prospects for you? If it's the day-to-day expenses you are having trouble paying and not just past debt, you may need to make sure you have a job on the horizon before the 341, lest you are forced into the same situation all too quickly.
