    Retained an attorney a while back but dont plan to file until may due to recent cc charges and baby coming in april, can i begin to tell creditors i am in the process of filing or should i wait until may to tell them and just deal with collections and creditor calls on my own until then? well it hurt to tell them now vs. waiting until may?? im just worried i will be sued before may when i want to file if i wait because i havent paid on most cards since november.....

    Unless you have a local creditor, you're probably fine. We started making less than minimum payments on 10 cc accounts in the middle of last year, haven't paid anyone anything at all since Dec, and won't be filing until May. Our attorney said even if we get served he can stall for us.

      If you retained an attorney I would ask him...If you've made recent charges then most likely you will be needing to pay the minimum payment on those credit cards..If you're referring to the cc's that you haven't used for a while that you will be defaulting on I would just screen your calls and shut your phone off at times....That's how I handle my calls....I have a neat feature on my phone of which I can block numbers once I've identified them as annoying.
      Your attorney usually instructs you to refer creditors to his office...I believe you give them your case number and your atttorney's phone number..
