    Halfway through chapter 7, house payment is late, 1 question

    I just finished the meeting of creditors yesterday, i am reaffirming my house which is 4 months behind as of right now, but my dad is going to borrow me money to get current but it won't be for another month yet, which i still have 60 days before my case is discharged,

    my question is since the chapter 7 provided an automatic 'stay' against foreclosure, and I'm 60 days out for discharge date, do i have 60 days yet to get my mortgage current before my mortgage company would proceed with a foreclosure? obviously after the discharge if i'm not current they can work me over, but i will be caught up but probably not until my discharge happens.

    by the way i filed pro se so i don't have a lawyer to consult with,

    Hi Lucky, welcome to the forum and welcome to the 60 Day Club.

    If the lender decides to start foreclosure they will have to peition the court to lift the Automatic Stay so that foreclosure proceedings can start. Now having said that, I would work on getting your payments current if at all possible.

    Do you have the Nolopress Ch7 book? If you don't, it is well worth your investment.

    There are many posters here that have had similar scenarios. I suggest doing a 'Search' for 'foreclosure', 'lift of Automatic Stay' and see what threads come up. Also read the 'stickys' in the COLLECTIONS and FORECLOSURE boards.
