Agreed, if lender doesn't care if you reaffirm or not, don't do it. I had equity in my car and low payment and still did not reaffirm. My 341 went smoothly also. Super nice trustee. He even argued that the value of my car was too much and the value was taken from NADA. Trustee went by auction pricing.

How much was your refund and did you list it as exempt? Did you use the wildcard or unused homestead portion?? Confused..

We don't have a wildcard here in Oklahoma. My refund was only $401. And we owe state so we were in the red when it was all said and done anyway. I am counting down the days now and praying for nothing else to go wrong.

we were sworn in by the trustee.
our atty asked my hubbie first:
--state your full name
--asked if everything in our petition was true to the best of our knowledge?
--asked if the past weekend we found out that FIL had titled 2 cars in hubbie name and his name without our knowledge(this was an issue we just discovered and had to amend the petition the day before the 341 mtg)
--asked if we had amended the petition on the 23rd
--asked if we were expecting any inheritance in the next year
--asked if we were party to any lawsuit
--asked if we we owed any money by anyone
Then atty asked me to state full name
--asked if my answers were the same as hubbies
Trustee's turn:

--asked if we had our 2008 taxes
she looked them over
--she then said she was abandoning our 2008 tax return
--she asked if everything in our petition was correct to the best of our knowledge
--she then asked if any creditors were present in our case

And that was it that I remember. Much easier than I ever thought it would be and we did not even get to watch anyone go first. I was so afraid of the whole car thing but only time will tell as to whether or not she is interested in the equity in one of the cars. Oh well. Nothing we can do about it now. Any other questions?

sorry i did not spell correctly. lol. i meant if anyone owed us any money. if we were expecting payment from anyone for anything or any service. also something was the trustee had sent us a letter before the 341 meeting and a statement on there by the trustee was that you cannot spend your 2008 taxes without her approval and if you receive any money for anything in the amount of $400 or more that is not a payroll check you are not authorized to cash or deposit it but had better be prepared to hand it over at the meeting and to bring it with us.
