    All you fabulous Gurus: Q about Property Tax

    Need your help. I searched the forum but couldn't find an answer.

    We are filing Chapter 7, in June-July 09.

    We will qualify only if we are current on our mortgage.
    We will try to keep current on it until then, but we don't have the money to pay for the second installment on property taxes due in April.

    My question is: Will the unpaid property taxes at the time of filing prevent us from using the mortgage on the means test, or do we have to pay them in order to use the mortgage on the means test.

    Thanks in advance.

    Just a little more clarification: We were thinking of stating our intention to reaffirm and then later in the process amend the petition and include the house in BK.

    You do not need to pay those to use the mortgage on the means test but the tax authority could force a tax sale if you dont' pay them.

      You can stop paying real estate taxes, but you will be billed for the difference. You will not lose your home for taxes in less than three years. Tax certificate would be auctioned up to 18% for three years. Then a tax deed can be applied for or your house would be sold on the Courthouse steps for taxes and the residual amount owed. ‘Hub

        3 years really? Here in South Carolina If you don't pay by November of the following year it's sold on the courthouse steps but I think you have 1 year to redeem by paying the buyer in full plus some interest amount.
