    does your refund get counted in the means test?

    what if you are set to get a refund but file before receiving it?

    Tax refunds aren't counted as income on the means test. What happens to your refund depends on whether or not you can exempt the money, and also varies depending on your trustee.

      Get that question answered before you file bk. Your lawyer can tell you if it can be exempted.
      If it can't be exempted, file your return and spend the refund prior to filing.

        Tax refund money is a return of a portion of money you paid the government based on your income. Basically, you have already been taxed on the money. It doesn't count towards your income, because it would be counting the same amount twice.

          good news! i called my bk attorney with some questions he said that the refund is mine and to spend it. it will be going towards his payment.
