Something I found out in a post the other day was that if the judge denies the reaffirm and they do. You maybe forced to surrender the car.
ya my atty mentioned something at the 341 about having to prove we could make the payment...
Pure shannagans I tell you. Why do I have to have the car on my credit to get approved for a 7, but then after the 341, I can get rid of it... I don't get BK laws.Filed: 11/25/08 - chp 7 no asset

My atty said that that credit line will come off my credit report, is this true? She is still obligated, but does not signing the reaffirm remove me from this obligation?Chapter 7 07/30/2008

There is one downside to not reaffirming an auto loan yet keeping the vehicle. The payments you make never appear on your credit report. If you are interested in reestablishing a record of on time payments reaffirmation will help. Otherwise, I can see no reason to re-affirm.Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

Sometimes they do report even when you don't sign a reaff. It totally depends upon the lender, I have seen it go a different way every time. Signing a reaff for the sole purpose of re-establishing credit would not be a good choice in my opinion. Seek other ways to re-establish without locking yourself in with a reaff.
