I had to take him to the emergency vet clinic, cost was $525 with the prescriptions. I used a mastercard I have not used in about 18 months. It already had $1,800 on it but the limit is $25K.

My attorney is out until Wednesday and I am now wondering if I just prevented myself from filing as the trustee may say abuse. I would have no problem paying the $525 back but I just dont want it to screw up all my other creditors which are mainly retail space lease and advertising agreements I needed to get out of.

Do I know have to wait 90 days?
If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

[QUOTE=2Bshinyandnew;245867]You say in one sentence you don't want to be rude and then in the next sentence you are rude and condescending. As I said a few strategically placed, "may", "could" "if I were you", or even "in this situation I have seen many people", negates the need to even apologize in advance for being rude

2Bshinyandnew - I think this thread has been bissected and dissected enough and while I warned the OP that what I was going to say was not meant to be rude, I should have worked it to state "you may not like what I have to say." If you reread the OP's original posting, it states in part: "My attorney is out until Wednesday and I am now wondering if I just prevented myself from filing as the trustee may say abuse. I would have no problem paying the $525 back but I just dont want it to screw up all my other creditors which are mainly retail space lease and advertising agreements I needed to get out of." I don't see how my or anyone's indication or reference to fraud or abuse should be taken out of line when the OP indicates it himself. You stated: "And truthfully, I don't see how anyone, moderator or not has the right to assume that anything someone did or didn't do was intended to be fraud. We can all discuss what fraud is til the cows come home, but ultimately I think the OP needs to know how their actions MAY be seen as, and not be told by another poster, especially a moderator that there actions ARE seen as" I and other posters have already stated what we feel his actions may be seen as as did his attorney. We are not giving legal advice we are giving our thoughts and opinions on what we see. This person is a complete stranger to us responding to him and we take the time to give him our opinions as to how we see his situation from how he posted and what he asked. The decision is ultimately up to the trustee but the problem is still there. Being a moderator on this forum does not make me better than anyone else on here and I post as I have posted in the past prior to being a moderator. The poster was advised as to how I saw the situation as he has been advised by others on here also. He needs to be ready to explain his actions and getting others views on the situation benefits him greatly.

I think the rest of what you posted in your most recent posting in response to what I had to say about all this is a bit beyond because others have stated the same thing (your reference to that he should have had cash in his pocket and not used the card). You seem to have made this thread all about how you feel as to how people should respond to postings and that no one has the right or authority to say what a poster should or should not have done or whether or not something they did could be fraud or some other action. And none of it was directed to the OP.

I believe the OP got some great advice and thoughts/opinions on this thread and I hope everything works out for him as to this situation and some good points have been raised for other posters as to what could occur if credit cards are used right before filing that will be included in the filing.
