    preferential payment

    My husband plans on filing ch 7 on March 1, 2009. We live in a community property state and have joint banking accounts. On December 9, 2008 we made a $1000 payment to my credit card with funds from our checking account. On January a $300 payment was sent out to my credit card as well. At the time he was the only one working. Will this affect his filing ch 7?

    It shouldnt. If trustee wants to he can go to the creditors to get the money back and split amongst all creditors, but depending on how many there are probalby wont be worth his time.

      he has lots of creditors

      probably 15 or so. mostly medical debts. plus we are due for a 1600 tex refund, any chance i can get my share?

          Sorry for being confusing. We live in Nevada, a community property state. I was wondering if my husband is filing bk and we always file our taxes together, would they take all of our refund. I got an education tax credit, which is most of our return, would I be able to keep my share of the return?
