    I've never herd about a debt having to be under $1600 but if you have less then that I don't understand why you would file. the attorney fee's would be around $1500.
    The CC's have most likely charged your accounts off and will turn them over to a collection agency so it's not likely they will talk to you.

        It sounds like there were charges/transactions that the attorney was worried about and wanted you to allow to age for a year before filing? Large balance transfers or purchases? Not sure what he's talking about with the limit... maybe you misunderstood something?

          Well, the majority of the debt (about $25,000) was charged in late 2007/early to mid 2008. He said there had to be enough time between the time I charged and the time I filed. There were some cash advances but none that would be very large (maybe $1000).

          I haven't paid him yet since he is still telling me I have to wait to file.

          Oh, and I haven't used the cards at all since August of last year. So there is already at least 6 months between the last usage and today.

                From the sound of it, I would say you're lucky you haven't paid him yet! Definitely go talk to other attorneys for free consults, something seems hinky about what this guy is telling you... but then, he may know something that we obviously aren't privy to here.

                  wow and I thought my attorney was conservative. Sounds like hes putting you off for some reason.. Go see several more attorneys, this guy didnt prepare you at all. You should of gotten your cc statements all printed out before you got 86'ed online (thats an old resturant term for your out of...like 86 baked potatoes..Now your going to call your cc's and ask for the statements. I wouldnt do that until you find an attorney and get some good advice ok? Good luck and at least you didnt pay this guy anything.

                    It was definitely my mistake for not getting the statements, I do have ones from August that I printed but I didn't print any previous ones. I do wish he had said something about that to me but I guess it's too late now.

                    I really don't want to go with a different lawyer since I don't have time to meet with others since I don't have much time to take off from work. I do know a few people who have used this lawyer and haven't had any problems with him. I will look into another lawyer though since you guys have suggested it; maybe I can find one with Saturday hours or something.

                    Thanks for all the advice...this is frustrating. I just want to get it over with before I move out of state.
