After several months of waiting to get below the median to file Chapter 7 we are almost there. We tried to file in October and found out that with my wife's old income from the job she lost with a medical problem that we made too much money. We did not want to go 13 if we could avoid it. Our attorney tells us we can file in March and the 2nd week will work for us it appears.
We have two threats to file against us in court with a a lawsuit to collect money but so far nobody has served us so I think it's too late to even get it into court now let alone get a judgement.
One thing I don't understand in this whole process at this point is why all retirement income not treated the same way regarding what is income for the 6 month period. For example we have a separate retirement system to SS We were told that SS does not count as income for the 6 months. We paid a like amount into this federal government retirement system.
Oh well, at this point I hope that they don't change the median figures on us before we file. I heard a rumor that the median is going down and we are within a few thousand for our area now.
I certainly hope that we never find ourselves in this situation again, that's for sure!
