Discharged, closed but waiting on "Trustees Final Report"?

Chapter 7 discharged 1/21/09
Final Decree and case closed 02/02/09

BK lawyer's office says I must wait up to 60 days to receive the "Trustees Final Report" which will break down what if anything was not discharged. Does this sound right?

The answer depends on if your Ch 7 case was an asset case or a no-asset case.

A no-asset case is done the minute the case is closed (exceptions are extremely rare and typically involve fraud discovered after the closing or an inheritance received within 180 days of filing). Getting a letter from the court is just a formality.

An asset case is done when the assets have been liquidated or payments to keep the asset or assets are completed to the trustee. An asset case won't close until all the assets are distributed to creditors. Then the trustee does an audit to ensure all creditors were paid properly. THEN and only then your case closes and the trustee sends the closing letter.

The answer to the original question if the case was an asset case is....how long does it take the trustee to do the audit? Typically the audit takes a month or two. When does the letter confirming the asset case is closed get sent out? That gets done when the trustee takes the time to tell his staff to send it out. Could be a few days after the audit is completed - could be several weeks.

If you used a lawyer to file, this is a great question to ask him/her to find out what to expect with YOUR trustee.

Is the report something that is typically sent out or do we need to contact our lawyers for this?

I just got my notice from the courts of my case being closed. Nothing from the trustee yet.
