    Regular seasonal overtime and median income

    I have been crunching the numbers and we qualify for chapter 7 without any of husband's OT. He gets OT every year, usually between December and April.

    If we filed in September or thereabouts, we would be fine for median income. But I noticed the anticipated income question comes into play on the schedules. If you have anticipated overtime on an annual basis, but based on filing timing and 6-month averaging you qualify, can you be forced into a chapter 13?

    Answer that question as no.
    He can't be assured of Ot. He has the option to turn it down. He could get sick and not be able to work OT.

      Overtime

      Actually, in his job, overtime is required in the winter. It is a given in his job. Although the amount varies from year to year, when it snows, he is working.

        But, you can't forecast the weather or, if he'll even be employed when it snows. Point is, you aren't lying by anwering no about anticipating future income.
