I have been crunching the numbers and we qualify for chapter 7 without any of husband's OT. He gets OT every year, usually between December and April.
If we filed in September or thereabouts, we would be fine for median income. But I noticed the anticipated income question comes into play on the schedules. If you have anticipated overtime on an annual basis, but based on filing timing and 6-month averaging you qualify, can you be forced into a chapter 13?
