    Tax Return & Asset vs. No Asset

    If you're a No Asset case, does the trustee still go after your tax return or do they only do that in Asset cases?

    If you can't exempt it, they can take it. We're no asset, but the trustee told us at our 341 that if our attorney couldn't find room in our exemptions for the amount then we might have to turn it over. We were able to exempt all but about $350 of ours and our attorney said that he'd be shocked if the trustee bothered with an amount so small.

      I was a no asset until my trustee found out I was getting a tax return and now I'm an asset case. They are only taking my refund nothing else. I am not sure if I could have used an exemption because my attorney didn't think about it.
