    talked to the attorney and now overwhelmed.

    We talked to the attorney a few weeks ago about filing. He said we will be filing for chapter 7. We got the paperwork to fill out and I got to looking at it and now I'm overwhelmed. I'm trying to fill this out as good as possible....Should I be worried about missing something? Is there a way the attorney can get all of my information that I may have missed?
    We have our own business. We done a job for a large company and ended up not getting paid for a $12,000.oo job and now we are forced to file bankrupt on our end... We were buying business property on land contract, so to make long story short...the original owners have taken that back..we signed papers last week. Now, I'm working on paperwork for the attorney to start the bankruptcy...sooooooo overwhelmed. I just want to crawl into a corner. It's bad enough trying to take care of personal things at home let alone the business..
    We have brought our little bit of assets we had at the business back to our home garage. We are continueing doing business from our home...which is a good move on our part. So, starting the bankruptcy right now is ideal, because we have hardly any income. We are working on getting our mortgage payment caught up.... Doing this before we file....
    Anyways thanks for listening and any advice is appreciated...

    take a deep breath

    I too am terrified of forgetting something or filling out something uncorrectly. I'm dealing with it by trying to break it all down into smaller jobs--doing it one schedule at a time.

    And remember, if it later looks like you messed something up, you can file amendments.

    Also, I have a day before my filing set aside just for going over the paperwork, that way I have sometime to make corrections.
    I think of my bankruptcy less as "walking away" and more as "gnawing my leg off to get out of a trap".

      Why are you filling out paperwork? Don't you have any attorney? When I went to mine, he did the means test and then gave us a list of things he needed. We didn't fill out any paperwork, excpet for signing the petition. What paperwork are you filling out?

          I agree with everyone. If you have an attorney, THEY should complete the paperwork. They may give you a checklist or something like that, but not the schedules.

          Honest mistakes will happen. This is an emotional time and remembering every little thing is not human. However, do the very best you can and no matter what, be honest and forthcoming. Don't intentionally hide a thing.

          You can always amend an honest mistake. You can be dismissed or go to jail for intenionally lying.

            I did my Chapter 7 paperwork online with a company that does only bankruptcies and I passed with flying colors at the filing and the creditors meeting. I really researched it and found a outfit that made me feel secure. So glad i only had to pay 190 to them instead of 700 or more to a lawyer!
            It was still a lot of work and stopping and saving then starting up again, but it was sweet when the trustee said I hadn't sent him a certain form and I said that I had, then he 'found' it in my file! ;)

              I do have an attorney. The paperwork he gave me has about 30 pages of asking about: assests, bank accounts, loans, collections,cedit cards etc. I have alot of assets as far as tools of trade. My house stuff isn't a big deal, but just trying to sort business and house hold is hard for me...lol..
              The attorney I have, went through and asked what all we had as far as our house, how much its worth and the same as for business. He also, asked us about income. He figured from that and told us we are definetly chapter 7 and more than likely a no asset claim. He just gave me about 30 pages of paperwork and said fill this out and we can start from there....just overwhelmed me. He also pulled our credit reports while we were there. We haven't started anything yet. I've just been trying to fill out the papers,as far as assets and bills, collections, etc. As far as, trying to hide anything, I have nothing to hide or lie about. Mines all self explanatory.
              But, my question is...Does the attorney have a way he can check to make sure nothing is missed? I don't want to miss anything because, If I'm going through all this stress making sure I have everything, I would surely not like to miss something.
              The other thing is, the attorney wants me to file ASAP because we do have a company sueing us and putting a lean on our property...that is where some of the pressure is coming from..so I feel pressed.
