    who do you list??

    when filing for bk, if you have a lot of old, old credit card debt that has been passed from collector to collector to jdb, who is it necessary to list on the bk. just the original creditor? or all who have tried to collect? what if a jdb has it listed on credit report along with the oc. ie providian 5k and then dirt bag collector 5k or does it hurt anything to just list all and everyone that you can remember having the acct?

    List anyone who has ever touched those accounts.
    List the OC and then, say sold, transfered or, assigned to xxx collection agency.

          List everyone - the more the merrier.

            I listed everything on my CR even stuff that was payed off and closed.

              I personally listed the original owner of my debt, the current holder, and current collection agency for each of my accounts.
              Filed Chapter 7 12/31/08 341 Meeting 2/3/09 No Asset 2/16/09 Discharged 04/08/09 :)

                DM, when do you plan on filing? I'm asking because of the "and growing" part of your post. Are you racking up more debt? If so, aren't you afraid that it will be seen as bad faith on your part?

                  I listed the original creditor and the current CA (if any). I left the amounts blank when I listed more than one creditor for an account so my total debt would be accurate.

                    It's been 62 all along. How can you rack up debt right before going BK? That would be fraud?

                    It costs almost $3500 for my attorney for us to go BK and to pay for the means test by the attorney.

                    It's taking me FOREVER to come up with the money since I have to be current on both car payments in order for both of them to qualify for the means test. If it wasn't for the cars, I would have been able to file a long time ago. The car payments combined for both cars are $1050/mo. They told me if one of the cars gets repossessed, then I can't use it in the means test since my income was a few thousand over the means.

                    I am going to try to pay off the attorney in full this next pay period. Then maybe in 30-45 days we can file.

                    This should be fun!! I want to see what all of the excitement is that everyone always talks about when going to their 341 meetings and such. I can't wait until it's my turn!! I want to make all of this 20 years of horror HISTORY.
