    Anyone NOT get discharged for Ch 7 after 341?

    Just wondering if there are any cases after the 341 that didn't get discharged? If so, what happened?

    Well, we are involved in a conversion to a CH 13 after initially filing CH 7. Our UST got involved right after we filed and demanded boatloads of documentation. Gave her everything she asked for and then she asked for more. To this date we've given her every single piece of paperwork requested (except for one CC statement for 1 month that we can't find but there were no charges (from 2006) and she went and subpeonaed for that one). We had to provide bank statements through 2006, CC statement back 3 years or to the date the account opened if after 2006.

    She really went after us and part of it was our fault. We did do a CC BT back in June/July-basically wrote the BT check and deposited it in our checking acct, then paid the exact same amt out of that acct to pay off another (higher interest card). Also we took 2 small trips over the summer, totaling less than $1K in expenditures, not charging anything, but used our bank card to pay for the expenses.

    DH lost his overtime in Sept, and that is the first time we even considered not being able to make our payments. We we not smart in planning for our BK or we would have waited longer to show less income and not be pushed into a CH 13 at this point. Our income was above the median and we showed $199 left over each month on Sch J, so that's what we'll be paying for the next 5 years. However, that income is based on the numbers that included his overtime so he is now scrounging around trying to get extra work and I am working way more than I ever have to try to keep up the budget and attend school FT.

    Anyway, sorry to write a book, but sometimes there are glitches that occur after the 341. Hopefully your case will be one of the MANY that go smoothly. Best wishes!
