    Renter in Florida & filing Ch. 7 questions : )

    My husband and I saw the lawyer yesterday and retained him.
    We learned that we will have to do a reaffirmation with the apartment complex because we have a lease.

    We have lived here for 6 years and have never been late once.

    Our lease is up in April 1 & have already signed the new lease that starts April 2nd till June of 2009 (14 month lease).

    My questions are:

    When we list the address do I list the Apartment complex office address or the main corporate office?

    Since my new lease is signed and I have received a copy can they now ask for additional security deposits?

    Or worse can they not honor the new lease?

    Does a reaffirmation add more time to the case being discharged?

    Where do you send your rent check? That is the address I would use.

    No. The apartment complex cannot change the contract. You could if you wanted to via the BK, but the apartment complex cannot. As a side note... since you will be eliminating your unsecured debt through bankruptcy, that makes you an even more ideal tenant. If they seem spooky to you about your BK, remind them of that.

    No. If you reaffirm, no.
