    Things will turn out ok hun, they always do in the end. It's just the anticipation and sleepless nights that is so nerve wracking.
    Gabriel - tell me about it. I am been on the phone all damn morning trying to get as much information as they are requesting. He is only giving me 18 days to come up with all the information. I have having trouble getting the 2 years of cc statements and probably won't have them by then. Ohhh how lovely.

    I am not sure if there is going to be a judge. Its a disposition, I thought there was no judges at Depos. but not sure.

    Ya know, its bad enough to go thru all this shXX and then to have someone constantly breathing down your neck. Ohhh i just want to hit em.... But i can't, although it would feel good! LOL.

      Jessegirl, I really feel for ya. As you know we are going through a similar situation. Our hearing is in March also but it is over the telephone luckily. I too am afraid of judges and such. You think they are going to rip you a new one but according to my attorney they are reasonable people and I agree that it is good that you get to tell your side in front of a judge. He is impartial remember, so just be honest and if you can't remember something then you simply can't remember it. They won't rip into you. They will show you respect.

      At our 341 my dad's attorney showed up and tried to rip into me about our means test and our withholding. As I was the one who did the paperwork, my hubby couldn't jump in (he's the calm, cool dude in our relationship) but I surprised myself and held my own and did quite good. In the end it did not matter because of his appearance the UST looked at our case and filed a presumption of abuse and most recently a motion to dismiss.

      Just remember: No one is going to die, no one is going to jail. Worse case scenerio you get thrown into a 13. That is the way I am trying to look at it. Good luck and keep us posted as you learn more!

        Just wanted to first send ((((HUGS)))) to you and let you know I'm thinking of ya every day.

        Sorry that you are going to have to go through this but no one said it better than Help! Get your stuff together, you have until your date in March so little by little gather everything you can. Save every receipt possible to back up your expenses. Have you been tracking spending in any way? If so, bring that.

        I really wish you the best in all this crap.

        Our attorney just filed the motion to convert (or whatever it is called) to a 13 and we are finally sleeping at night knowing it will be fine. The UST ended up being involved in a case that someone from our church mentioned (we are taking Dave Ramsay's Financial Peace University in person) and they talked about their bankruptcy. They talked with me & DH over coffee later on and said that the same UST put them thru hell & back for over 9 months until they finally just gave in and converted. The wife ended up having a breakdown and was hospitalized over it, mostly because she had no one to talk to besides her DH and she couldn't take the stress of the constant demands for more information. They wanted bank statements going back 6 years prior--I mean--how ridiculous!!!

        I just mention it to show that you need to be able to vent and talk about this and get support from whatever source you can. I know you can get thru this if you take it one day at a time!

            Thank you so much to all my friends. Again, I do not personally know any of you but I feel like a have a great line of friends backing me. You all have my back and for that I thank you.

            I was like a bulldog today!!!!!! I called everyone of my creditors again and told them that letters were sent and that i needed this information asap. Almost all of them complied. They were so nice and gave me good wishes it was like someone brought all the nice creditors to me today. So that really helped me out. I called all my utility companies and request all bills, which they are sending them to me. I just need to find all loan applications for the boat and my vehcile. The UST wants to see that to. I think he is looking to hang me, but truly I have nothing to hide. Absolutely nothing. I will fight this, even though i am scared shitlist.... LOL but that day i will be a cool chick....

              You know what Jess? "Someone" didn't bring you the nice creditors...YOU just stood up for yourself and DEMANDED action...and you got it!! Good Job!!! I'm proud of you!!! You go girl!

                  Everytime I see your name on a post I hope for good news. One of these days it will be! I can't imagine how stressfull this is but keep coming here and getting it out and you will get thru it. I am hoping for a good meeting for you.

                    Take a deep breath THIS SUCKS period.
                    Stay strong for your kids and focus on them for strengh.
                    Now you have to get into warrior mentality.
                    Show up to the examination if you want to lol and get this over with.
                    Make a final decision and let it be.
                    The USTT wanted everything from me you could think of from 05 till current.
                    He wanted to know about tghe chocalate bars I sold in school.
                    Did I have all that? HHHMMMM NOPE. I told them I am not a book keeper and didn't take accounting in school. The reason I share this with you is I to went crazy too over all this, lost allot of sleep and worst of all my kids notice my anxiety, tension and stale persona when all I was thinking about was my case. The atty or the USTT didn't go thru all this BS but we fliers do, keep your head up regardless the outcome and remember this too shall pass.

                      I haven't read through all of your posts but wanted to offer you this. If you have done nothing wrong (i.e. illegal) which I'm sure you haven't (this is just some bully trustee) - then you have nothing to worry for. Like others have said, view this as another hurdle to get over and try to calm down because the stress isn't worth your health. We all obsess over our bks but try not to let this situation dog ya. Due diligence is good for preparing but don't forget to take care of yourself in this process. You have truth on your side so you will be just fine.

                        Jesse, good for you for standing up to your creditors! I'm so sorry for all you are going through. Don't give up no matter how close you are the breaking point. You are stronger than you think and you will get through this. While you're in that deposition just picture all of us cheering for you! Go Jesse! Go Jesse! Go Jesse!

                            It might help to remember that the BK process is basically a bunch of rules and parameters set up by the govt. to protect both the debtor and the creditor. While the UST is looking out for the creditor and the BK process itself, if you fall within the guidelines of the BK rules and have your evidence to back it up, then the law will protect you. At least that is the theory. Don't give up!

                            Try to think of the process as a big test. All your evidence, cc statements, receipts, proof of income are the answers and if you have all of it or most of it, you should pass. So even though they are putting you through hell, you have the capacity to pass this test and your diligence is what is going to get you through to the end to your passing grade. If you have the proof that you qualify for BK, then they can't change the rules to say you are not a fit. You may have to fight like hell, and they may have to put you in the remedial math class ( ch 13) but if you have the stuff to prove you qualify for a 7 or 13 then the BK code is going to eventually get you there and a judge should see that. For whatever reason, the T is giving you hell, but if you stand your ground and give them what they need you are going to come out the other end OK. Do a hell of a lot of research and educate yourself on how to respond if your attorney drops the ball. Know each subsequent step. Go through your figures and assure yourself that you qualify under the code and re-assure yourself that you are in the right and maybe that will help you feel better and stronger in your conviction that you are doing the right thing for your family and that you will eventually get to where you need to be BK wise. We are all here for you and support your hutzpah to fight this (really bad cuss words)! Vent away and keep us posted. Get the a-hole the stuff he needs and know that you are doing your best and that is all you can do. Your persistance is what is going to get you through this. When it seems like you can't do anymore, just remember it will all be over soon and this Summer you will be feeling a whole lot better, focus on what it will be like once you are discharged and not on the hell you are going through now. Stay tough, we are all supporting you!

                              Thank you all so much. Your encouragement has really helped me. I am going to fight this. After all, I qualified for the 7 and I deserve it. I am going to fight like hell. My income is still the same as it was, but my living expenses have gone up. My taxes just went up 500.00 a year. SO I will let him know that for sure. My heating bills have sky rocketed. Dec. being 650.0 and Jan. being 694.00 (propane) is killing us. But we had only put in 500.00 for gas an electric, so agian I will let him know that too.

                              I am going to start another thread on:
                              What should I expect at this deposition? Is it kind of like a 341? Is there some kind of a time limit? If someone can explain the process I would truly appreciate it. So atleast I know what to expect.

                                Jesse it sounds like things are beginning to turn the corner for you with your last post about getting credit card statements. Hopefully you will build momentum and continue with good outcomes. Keep your eye on the end and continue to take those little steps to get you there. I truly wish you the best. My wife trusted me to take care of most of the BK stuff. She knows I visit the forum. When she had made some complaints I made her read one of your earlier posts.. She is now thankful ours went as expected. I pray that you do not receive anymore trouble and come out of this without anymore interruptions and distractions.
