Hah! They get buggy and slow just after a couple years of use. I'm on my 6th one in 10 years.

My Dell Account was at about $2800 when I filed last year (beginning of 2008) - when I looked at my pacer, I saw that they had made a claim for $200 against me but nothing was done about it and it was all discharged. My attorney told me that the computers depreciate so fast and its not worth it to them to come 'repossess' them - but they will make a claim hoping that they get some of the money for them.

K ready for this post. I had 22 Dell pc's, 22 Dell 19" flat panel monitors and 1 Dell Poweredge 1950 Server.

I called the agency that was handling our DFS account a week before the business I owned closed it's doors to make arrangements to return the computers to Dell. I was informed that they didn't want the pc's they are considered obsolete to Dell. Just make sure to include Dell in my bankruptcy or they would be going after me because I had signed a personal Guarantee. The pc's and server were just under 2 years old at this point. My Dell account balance was at $16,000. They told me to sell them on E-bay.

The pc's are valued now at about $2,000. Anyway so if they didn't want all those pc's back I am sure they aren't going to want 1 back.

So it sounds like Dell will not repossess anything .... but in the unlikely event that Dell or any other secured creditor intends to repossess property in a Chapter 7, what are their specific rights in a purchase money security interest? If they have not contacted the Debtor in over 3 months, not @ the 341 nor before the Date of Discharge, have they missed the deadline? Or must the Case be Closed?

My Statement of Intention lists "Surrender" on 2 items of secured collateral, and I have not heard anything back from these Creditors since my Discharge.

The automatic stay is now lifted. Technically, have they missed the deadline, or can secured creditors issue a Writ of Replevin any time in the future to repossess the collateral? I just need my peace of mind back LOL I still don't know if these Creditors have forfeited their right of repossession.

Dell is the best secured creditor! They did not repossess my laptop ... And they even honored the existing warranty on it!

As the poster with a business full of PCs and server equipment is an indication of, Dell finance doesn't want your computer back. They would have to send it through refurbishment and it's totally not worth their time and resources to take it back from you. I was under the impression that Dell Finance was actually not part of Dell, but a contracted arrangement with Citibank. Perhaps they have more than one financing setup.

Dell can hardly sell their new PCs right now, what would make them want old ones that need to be refurbished?

I purchased a Dell in 2009 and filed for bankruptcy in July, 2010. (My DFS account was included in the filing). I have heard nothing from them.
