Still Not Discharged..Sigh....

I've been so patient. I filed on 8/1 and had my 341 on 8/28. Declared no asset and no problems as far as I can see.

The clock on pacer didn't start ticking until 9/09 or so though. I check pacer every week or so and the only unusual thing I have seen is that on 11/28 a creditor (GE MONEY) that had already been paid off so was not included in the BK, claimed they had been a creditor and was requesting to be notified of all bankruptcy communications...I saw that my lawyer complied. I called GE Money at the time and they confirmed that I didn't owe them any money but then realized I had filed BK and wouldn't talk to me any further.

I thought that was stupid and tried to point out to them that they couldn't possibly violate the automatic stay because I didn't owe them any money but still they wouldn't talk to me.

Then I saw on Jan 2nd, this request has been ammended to say that the creditor was added in error. I don't know if it was they or my lawyer who ammended it..I can't tell.

Anyway, like I've said, I've been patient because things are quiet and things are good. Quiet is good.

But I really want closure. I know there have been posts on here about who to call, short of the lawyer, to expedite this, and I apologize for not being able to find them. I have been taking a break from this site. If anyone can point me in the right direction, I would truly appreciate it.

GE money bank did that on mine too and I also did not owe them anything. But i had an open CC with them.
have you asked your lawyer why he thinks it's still open?
are there any other flags?

No, you would think I'd take my own advice and just call the lawyer. I just don't feel like it but am going to have to soon I suppose.

There are no other flags...nothing.

GE had already closed that account before they made the request. And my simple case really should have been discharged before that even happened...although I do realize there is no guarantee, yada yada yada, so please no one chastise me for expecting what is the norm.

Clearly this isn't and I accept that.

Wow, that is strange, since you filed and had your 341 before I did. I received my discharge at the end of November.

It is probably just an oversight, or a backlog of paperwork. I would bet a couple of phone calls on Monday will take care of it!

We too were hung out to dry, until I called the bk Clerk who handed me over to another clerk responsible for my case (they bo by alphabet) and she stated "Oh you need to send us a copy of your marraige license" (We use two different sir names) so I faxed a copy to my lawyer, and within an hour, I was discharged. No one knew or thought to ask until I asked. Try it. It may just be a technicality or you may already be discharged and someone failed to update PACER. 'Hub

Hmm... GEMB did the same in our case, and the account had been paid in full a year prior. I wonder why they would do that? It sounds to me like you slipped through the cracks on some court clerk's desk. That's a long time to wait.
