Before I filed BK my air conditioning went out and it gets about 100 degrees here in the summer. I needed to have it replaced and the heat was unbearable. Since my credit wasn't completely shot yet, I was able to get a visa to have the unit replaced at a decent price for this area. Unfortunately the visa was with the bank holding my 2nd mortgage (cross collateralization) and I wanted to keep my home since the mortgage(s) are affordable and in a decent neighborhood. I'm currently repaying the $3500 charged on the visa so I can keep my home (because they can start foreclosure if I'm delinquent on the payments), but it's worth every penny because I would have suffered a heat stroke if I didn't.

I understand your pool is a different story, but if you don't want additional damage to it and the pool co. is willing to take installments, you might have to bite the bullet and get it repaired and take your chances with the Trustee. It's not quite the same as replacing an a/c in 100 degree heat, but if you properly document the consequences of not having the work done, the Trustee might understand. It might work and it's worth a shot, but be completely prepared to have this money scrutinized by the Trustee and prepared to defend the repairs if it comes to it.

    Good Luck.

I am just going to fix the pool and move on and just deal with it. Too much stress and I cant just let it cave in...that would be dumb and more expensive in the long run, even if we fill it with dirt
