    tax return and filing timing

    We are just over the median income because of my husband's overtime he gets in the winter. We still qualify by the means test, but I am worried because we pay private school tuition for one child and I don't want that to mess things up and be forced into a chapter 13.

    If I wait until September to file, we would qualify using the median income, so I think I would like to wait. But, at that point I would be almost 1 year past due on CCs. Don't know how that would hold water.

    However, I think we will be getting a good tax refund this year. If I don't file until September, by then I would have received my property tax bill and was thinking of using that for paying my property taxes (which are billed in August and due date is November). Would the trustee still expect that refund back? Put it this way: If I don't pay them with that, I won't have the money because we haven't had the extra to set aside because of so many bills now.

    Sorry, I know this is a loaded question, but I think everything needs to be considered here.
