    Means Test

    I did an online means test to see exactly how close we were to the magical $100 disposable income left over to see if I needed to come up any other expenses. HA HA My result came up -$489! We have retained an attorney and they have already performed the means test and confirmed that we passed, but I was just curious how much wiggle room we had.

    Anyway, is this going to be a problem with the trustee like how are we going to make it?

    In our county the standard amounts used for like auto repairs and expenses, food, clothes, out-of-pocket healthcare were all high based on what we actually spend. If I just explain that to the trustee (If it comes up) will that be sufficient? I have already done a new budget taking into account our new income figures for this year and we will be cutting it close, but we will be okay. What do you guys think?

    Honestly all this will be taken up with your attorney and ironed out on exactly what should be listed, and how. Usually they know what you can get away with and what trustees sometimes will frown on. As far as the means test, if everything you put down was completely honest, and for the most part you can back up you should be fine. I was on the border of chapter 7 and actually was told I would need a 13 on my initial consultation. After it was all said and done I got accepted to a 7.

    And this was when I was positive a few hundred on the test.

      You are saying you are UNDER the IRS Standards, right? You should be a go for a ch 7. Talk to your attorney, he/she will know your district better.
