Thanks to this board and all the excellent advise and comments contained here I was able to present my plan of filing. I finally got an answer from a local attorney about my situation. I had been reading his very detailed website on bankruptcy in PA and asked my questions as I had asked here.
Heres what he said.
Dear Mrs. ___
Yes, true, a lot to digest - but it is perhaps the most comprehensive
email any prospective client has ever sent me.
You may have called it exactly right with your concluding that you
may qualify for a Chapter 7, only because you own no interest in the real
estate, and that your husband appears to not qualify for a 7, because he
has more than $XXXXX equity in the home (which you have never owned).
He would therefore have the option to file a Chapter 13 in a separate filing.
Wow, that took the biggest load of my mind. Looks like I've got my basic plan of attack! You guys are great!
As a side note, he wants me to get a FMV on the home asap.
