Just talked to Larry today to get a few questions answered, and I am thrilled!!
1) talked about adding our state tax refund as an asset and not filing state return until the Apr 15th deadline, mostly because California is holding returns this year (we hope to file BK on Apr 1) --he said it shouldn't be a problem to do that, as long as we stay under the total wildcard exemption This is awesome, because then we have extra money coming in after filing to help us with our fresh start!!!
2) which led me to ask, is the Trustee more likely to hastle us, since we will be claiming $5,250 pending com. check + $2700 refund check as assets? Total of almost $8,000 cash --he said it shouldn't be a problem, he hasn't seen the Trustee fighting people over assets if they are within the guidelines - even cash!!
3) I also asked about cc statements going back a long time like what I've read about on this forum --he said he's only had that happen once, going back 12 mos of statements, and that person did a lot of cash advances in the year prior to filing- he also said the Trustee was only looking for preferential payments, asset transfers and luxury item purchases and that nothing came of it in the end! Since my last cash advance/check was something like Apr 12th, we may wait til that is actually a year old
4) Household inventory he said not to list bedding, towels, consumables, utensils and small household items - just stick with the big stuff
5) This one is huge! He said not to bother talking to any creditors anymore!! That at this point, nothing would come of any of our accounts even if we wait until mid-April to file. He also said that if anyone bothers me too much, refer them to his office
