Between us, Hubby & I have 3 checking accounts and 1 savings account. We filed Ch7 last month but our attorney never asked for copies of our bank statements. He just asked what the balance was in the accounts. I keep reading post here that are mentioning submitting copies of bank accounts. Should we be concerned?

Do you have to supply copies of bank statements?

Well, I sure had to provide copies of bank statement; they were listed on my attorney's initial intake sheet (along with copies of paycheck statements, taxes, and a few other things.) Did you already have your 341? My attorney had my bank statments when I retained him and filed, but the trustee asked to see the copies again at our 341 meeting (my attorney had them). I filed, my wife did not, but I had to supply copies of her checking account statements also.

Well, perhaps it won't be an issue then. If your attorney never asked/insisted on them, and the Trustee didn't ask at this point, then maybe no one cares. In my case we were way over median income, and like I mentioned my wife did not file. So I know they were rather interested in our cash flow. I know they looked at our statements and did in fact send some questions to my atty regarding some of my wife's expenses, both as claimed on our budget/means test as well as her checking account (in the end, my wife (who's like double pissy) told the trustee, me and the court to butt out of her finances--she didn't file, I did, and she wasn't changing her ways and spending habits to pay my bills). Anyway, I guess at this point you can just wait and see if anyone asks for the statements.

Same goes for trustees. A few do ask for account printouts before your 341, but most trustees only ask you to bring a form of ID with a picture on it and your SS card to the 341.
If your 341 has already come and gone without a request for your account printouts, then it's 99% that you're fine. (I never say 100% - it's a superstition of mine.) So don't stress, ok?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

My BK lawyer didn't ask to see statements either. Just asked about the balance on the accounts at the time of filing.
I did get a letter from the lawyer shortly before my 341 that said to bring copies of the bank statements that covered the filing date because the trustee would ask for them. However, the trustee never asked to see them.
I'm glad that this question was posted, because I was wondering the same thing.Filed 12/24/08...a Merry Christmas indeed!
