    Citi Financial AGAIN

    I will have the total money for my lawyer within 1-2 months but this stuff with CITI Financial is driving me CRAZY.


    Background:

    Took 6k loan from them July 08 when I had 2 jobs

    Lost Job end of August

    Paid Citi financial the payments in August, sept, oct, and november. Did not Pay Dec but gave them 100.00 in Jan to stop their threats.

    They call about 50 times a day. They sent me something via UPS on Friday saying they will take me to local court/district magistrate within 10 days if I do not pay them. Today I get a voicemail saying they are filing with the district magistrate on MOnday at 2 pm if I do not pay them or sign some new agreement with them.

    I do not want to sign ANY new agreement with them since I know I am filing a chapter 7 when I can pay the lawyer. I feel that if I sign some new agreement with them it would be fraudulent since I know I cannot pay them back. Am I right in my thinking?

    Also if they take me to the local magistrate I think that will move fast since it is a local court. Is this going to mess up my chapter 7 when I file and will the lawyer need even more money then?

    I am having the hardest time trying to come up with the money as is!!!

    Stay away from Citi Financial!!!! They are LOAN SHARKS!!!!

    Yes stop paying them.

    Of course their are loan sharks. Just look at the way they are raping the U.S. taxpayers.

      Is it a possibility to put a retainer down on an attorney? The reason I ask is that we gave our attorney a $500 retainer earlier this month and they said to go ahead and start sending all collection calls to them. We did not pay BofA credit card Dec or Jan payment and missed Jan payments with Citi (we have 2cc accounts with them).

      Maybe we got lucky so far and may jinx myself but after one collection call we told them we would be filing Chapter 7 and to call our attorney for anything further. We have not even filed yet and probably won't be able to until next month at the earliest.

      I don't know, just a suggestion, and the calls may start up again next month so I may be speaking to soon. Between the 2 cc cards with Citi we owe them around $40,000. Maybe it depends on how much you owe them?

        yup same thing happened to us and they called me Christmas Eve at work threatening me. After that we retained the attory (only $500 to retain) and then tole them that we were filing bk and not anohter phone call at all. just tell them u are filing ieven if it is 2 months away.

          man i can't spell. anyway just tell them you are filing and you won't have to deal with them again. if you for sure know you are filing then i would tell them. they are paid to do that to you and to scare you into paying. they go to special training classes according to our attorney that teaches them how to do that. you also should read up on not paying creditors within 90 days of filing. i think there is some rule of thumb on that but someone else can step in here and tell me if i am wrong on that issue.

            Sadly, everyone figures this out too late! There's a reason why they have like 6 offices in any major city. They hire people who were former collection agents for banks... for a reason.

            Just call them and inform them that you are filing for Bankruptcy. They'd rather save their money than waste it filing with the local court.

              I don't think they can just "take you to the magistrate" in 10 days either... I think they have to serve a summons and you have a certain amount of time to respond. I think I read on here it's 20 days. Also, they are breaking the law calling you that often!

              This is really bizarre, because we have two accounts with Citi, combined total is over 33k, and they only threaten me with "the next step" whatever that may be. Maybe it's because yours is a loan and ours are cc's? I don't know, but it's awful that they are treating you that way!

                Actually since CITI is the original creditor, they can call as many times as they want any time they want. Only secondary creditors who bought the original debt are forced to obey the Fair Debt Collection Practices Act.

                Even secondary collectors can call as often as they want between 8 am and 9 pm until you actually file bankruptcy. Only filing can stop the calls completely.

                  Really??? That's insane lol. I thought I had read on here somewhere that there was a limit to how many times they could call! I stopped paying attention to mine anyway ever since I read on here about setting everyone's ringtone to "Mute".

                    I'd tell them you're filing. That will probably slow them up from 'filing with the local magistrate.' And, as someone else mentioned, they can't just instantly drag you to court overnight. They'd have to formally serve you, which at least in my area gives you 20 days to respond to the claim. If you have no job and no substantial assets, then even if they get a judgement there won't be much they can do; further, though, you could provide an Answer to the court if they DID actually file a lawsuit simply stating that you're filing a BK case. I'd see if the attorney you've talked to will give you some advice. Also, do you know for sure you're filing a 7, not a 13? Maybe your attorney would work something out to at least get you filed, even if it's a Ch 13, which would cost less to retain him/her. When I got desperate, my attorney worked a deal with me to get me filed and stop the wolves.
