    I will be sending the letters to my CC's please help me out

    Hi all, Well I am getting ready to send out letters to all my credits, asking for 2 years of cc statements that the UST has requested from me. As many of you know I got down to the last 4 hours of my discharge and the UST hit me with an extension with i guess hopes that they can dismiss me. The requested a bunch of stuff from us, which we complied until they asked us for 2 years of every credit card statement that we got. We not sure if anyone keeps every credit card statement for 2 year, but i didn't. So natually, i cannot produce what the UST has requested. I am getting ready as a last hope to send every credit on my matrix a certified return receipt requested letter asking for the 2 years of statements. Now, how do i draft to letter? WHat do I say? I do not want to rock the boat with any of my creditors as far as, saying that the UST is requesting this, cause maybe it may stir them up to put a claim in. How do i write this letter to not make them think that I am being audited by the UST?

    I would try to base it around the trustee is trying to decide if you qualify for Chapter 13 Bankruptcy. In addition, I(you) need to provide 2 years of credit card statements to the US Trustee from your( credit card) company to see if your company will be included into a payment plan if "I" qualify for chapter 13.

    CC: your attorney.

    Have the attorney review it before sending it out.

    My thought, if you can lead them to believe they stand a chance of recouping some money they may want to work with you.. I guess, how do you do this without opening yourself up or actually making them think you will pay? Just a thought.. others?

    When writing the letter think along the lines of how will it benefit them to give you 2 years worth of statements?

      Yeah, I do not want to open up a can of worms and i do not want them to know that the UST is looking to dismiss my case or is even involved with my case. I am stick between a rock and a hard place. Not sure how to write this letter. I DO NOT want to raise any RED flags with the creditors as far as making them think that the trustee has other plans for me. Cause lets face it the UST is for the creditors and not on my side at all.

      Any suggestions from anyone??

        What about asking for annual reports instead of each months statements? Sometimes you PAY for those, and maybe you'd have to but it sounds like money well spent. Seems like that would be easier for them to produce anyway? Just a thought.

          My advice would be to simply request the statements. I would not reference the BK in any way. All it needs is your heading, the date, the name and address of the creditor, the account number and your signature. One simple sentence in the body: "We are hereby requesting copies of monthly statements for the above referenced account for the dates ##/##/## through ##/##/##. Please send them to the address above."

          That's all they need to know.

            And one more thing... if one of them objects to your discharge after ignoring your request you'll have certified mail receipts showing that you requested information about your debt and they failed to respond.

              I also thought of this. Some times the KISS(keep it simple stupid( approach is the best method. Do this and
              CC attorney and US Trustee on the letter.

                  Took 115 days after 341 - But Finally DISCHARGED 3/25/09

                      Hey TEW - No I know that they know that I filed. But the problem that I have is that, I do not want the CC companies to know that the UST is giving me a problem cause then maybe they will try to object to my BK. Can they do that?

                          TEW, here's where I'm going with this. It's pretty unlikely Jessegirl is going to get any of the statements, so this is more a matter of putting forth the effort and documenting it. Any letter that references a BK is going to go straight to a BK dept., which is a dead end. If there's no BK referenced, there's always a chance the lower-level customer service rep. who receives the request will go ahead and send the statements.

                          In the event the request does end up in a BK department, I think it would be better not to include the UST request as this could draw attention from someone who actually knows what they're doing. If the UST is aggressively pursuing a debtor, the creditor might get the impression there's something they can object to. Better to lay low, in my opinion.

                            I agree

                            less is more, you are asking one thing, 2 years statements that's all you need to ask for ..........that's all they need to know. Nicely ask for 2 years statements, they do not need to know why.

                              I am new to all this, but you are paying a lawyer, correct? Why can't you just have the lawyer request the info form the CC companies? I am sure he has more experience in wording letter so as not to put up a red flag.
