    Pending Lawsuit and Chapter 7

    I am currently a plaintiff in a wrongfull termination suit against a government entity. I met with an attorney today and he advised me there is a 60% chance the trustee would hold up my discharge until there is a resolution in the lawsuit which in Riverside County, CA could take years. Currently civil cases are 30-36 months backlogged in Riverside County. The attorney recommended I file a chapter 13 as the lawsuit would not be looked at as an asset.

    Has anyone else had a similiar situation? Should I go meet with another attorney?

    Did he say the Trustee would hold up the discharge or the closing? Those are two different animals. Is this your first consult? If so, I think people usually advise that you talk to 3 or 4 attorneys before hiring one.

      He basically said the trustee could (60% chance) hold the case open until resolution and could consider my causes for action as an asset. If I could settle the thing now and be debt free I would but they are going to drag it out.
