      optimistic1 - in the irs website you gave me - is that just for fed taxes? or all creditors? also, the moving part i got from there... in the second to last paragraph on that page...

      "Also, if the spouses change their domicile to a non-community property jurisdiction, any property subsequently acquired by the nondebtor spouse is not community property and would be available to the creditor. The creditors of the nondebtor spouse generally can collect claims incurred by the nondebtor spouse from the separate property of the nondebtor spouse regardless of the discharge. "

          sorry didnt even think about it!! How long can you go with out paying them? we are waiting because of balance transfers and say you paid for 3or 4 as many as you can and then not pay for a few months dont they still look back to when you were paying? people could not pay for a year and then file and they would be in the clear right?? I wouldnt think the cc would wait after 2 months! i dont know

            I defaulted on my cards 5 months before I filed and was never sued. Many here have gone years with no payment and no lawsuit.
            Always file on terms and a timeline that is to your advantage-not your creditors. Any judgment resulting from a lawsuit will be discharged in bk anyway.

                Very true. It just depends on the creditors. I stopped paying my cc's over year ago and haven't been sued (owe 72k)..knocking on wood as i write this...
                File when the time is right for you, you can't sit around worrying if you are going to be sued or not.
