That is the trap we fell into! We now have 150K in credit card debt!!! I guess I am a few steps ahead of you there. But we fell for it and you know what, the only way you can get yourself that far into debt is to pay your bills on time! want to know what we would have done a year ago? We would have taken the 12k from the credit card plus some, paid mom back and used the rest to keep us going. We would have made a + b = c. We didn't do this on purpose, there was no scheme, no plan, we just did not know what else to do, how to keep from going under, how to keep paying our bills! We paid them on time alright but did so because we borrowed from somewhere else. Do I need a 12 step program?!

you can put it in your name, you will just have to wait at least 1 year before filing, perhaps more like 18 months. Otherwise the trustee could take the
12k back from her and distribute among your creditors. AND you'd still ower her the 12k on the loan....not good.
